Welcome to Nautical Marketplace. These Terms of Service ("Terms") govern your access to and use of
www.nauticalmarketplace.com and related services (the "Service"). By accessing or using the Service,
you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
2.1 Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use the Service. By
using the Service, you represent that you meet these requirements.
2.2 Account Registration
To post listings or use certain features, you must create an account. You agree to:
• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably
believe are associated with fraudulent or illegal activity.
2.3 Nature of the Service
Nautical Marketplace is an online classifieds platform that allows users to post and browse listings for
boats, yachts, commercial vessels, marine equipment, maritime services, cargo, charters, and related
items. We are a platform only. We are not a party to any transaction between users. We do not own,
inspect, guarantee, or take title to any items listed.
2.4 User Content and Listings
You are solely responsible for all content you post, including listings, descriptions, photos, and
messages ("User Content"). You represent and warrant that:
• You have all necessary rights to the User Content
• Your User Content does not infringe any third-party rights
• Your listings are accurate and not misleading
• The items you offer are legal to sell and you are authorized to sell them
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display,
reproduce, and distribute that content in connection with operating and promoting the Service.
2.5 Prohibited Conduct
You agree not to:
• Post false, misleading, or fraudulent listings
• List illegal items, stolen goods, or items you are not authorized to sell
• Harass, threaten, or defraud other users
• Use the Service for any unlawful purpose
• Attempt to circumvent security measures or scrape the Service
• Impersonate any person or entity
• Post spam, unsolicited advertising, or irrelevant content
2.6 Transactions Between Users
All transactions are solely between the buyer and the seller. Nautical Marketplace does not handle
payments, take possession of items, or guarantee the quality, safety, legality, or condition of any item.
You are responsible for conducting your own due diligence, including inspections, surveys, title checks,
and verification of the other party.
2.7 Fees
Basic use of the Service may be free. We may offer paid features such as promoted listings or premium
seller accounts. Fees will be clearly disclosed before you purchase them. All fees are non-refundable
except as required by law or as otherwise stated by us.
2.8 Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by
Nautical Marketplace and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works without our prior written consent.
2.9 Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,
WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT
WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
2.10 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAUTICAL MARKETPLACE AND ITS
OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS
OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE
SERVICE OR ANY TRANSACTION BETWEEN USERS. OUR TOTAL LIABILITY SHALL NOT
EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE
CLAIM.
2.11 Indemnification
You agree to indemnify and hold harmless Nautical Marketplace and its officers, directors, employees,
and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees)
arising out of your use of the Service, your User Content, your violation of these Terms, or your
violation of any rights of another.
2.12 Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice.
You may stop using the Service and request account deletion at any time. Provisions that by their
nature should survive termination (including ownership, disclaimers, limitations of liability, and
indemnification) will survive.
2.13 Governing Law and Disputes

Terms or the Service shall be resolved exclusively in the courts located. You
